El 09 de Junio 2020, en el Diario Económico Gestión se publicó un resumen de la declaración realizada por el Superintendente de la Superintendencia Nacional de Salud (SUSALUD) Dr. Carlos Manuel Acosta Saal, ante el Congreso de la República donde asevera, que luego de la investigación preliminar de auditoría realizada en su Institución, respecto de la denuncia contra instituciones de salud privada por presuntamente lucrar al momento de realizar pruebas moleculares de covid-19 por hasta S/ 7 millones de Soles, se habría determinado que dichas clínicas no habrían cobrado por la prueba molecular, sino que se habría cobrado por otros productos y servicios complementarios para la toma de dicha prueba, y por consecuencia dicho actuar es legal.
En efecto, las reglas o normas legales que rigen la economía corresponden al ideal de sociedad que los pueblos desean tener.
En dicho sentido la economía regula la forma en que se van a producir los bienes y servicios, así como para quien se dirigen los mismos, tomando como premisa la escasez de recursos, dado que si no fuera así, no tendría sentido la regulación de dicho aspecto de la sociedad.
Siendo la economía una ciencia social, el Estado no puede soslayar su participación en ella, buscando que esta sea benéfica para la misma.
Dado que la economía es uno de los factores que posibilitan los ideales de los actores sociales y posibilitan la vida en común, el Estado debe estar presente en esta regulación, por lo que la pregunta a realizar desde este punto de vista, es ¿hasta qué punto el Estado, y específicamente el Estado Peruano puede intervenir en la economía peruana en la regulación de precios de productos de alta necesidad médica, así como de los servicios conexos para su utilización y finalidad?
De lo antes señalado se deducen dos cosas:
– La necesidad que el Estado intervenga de alguna manera en la economía para evitar posibles abusos
independientemente del sistema económico elegido y
– Que esta participación estatal se encuentre de acuerdo con las reglas del sistema social adoptado por el
País.
Límites de la intervención Estatal
Estos límites dependerán del sistema económico o modelo económico establecido por el País, por lo que la emisión de normas legales en este sentido llevará a resguardar este sistema económico y en su caso buscar el cumplimiento de dicha finalidad.
Según Mc Graw – Hill, en su libro “Fundamentos de le Economía” Los sistemas económicos podrán ser Sistemas económicos de economía centralizada, donde es el Estado quien establece las reglas de todo lo que ocurra en este sistema siendo muy poca la intervención privada , Sistemas económicos de economía liberal o de mercado donde los objetivos económicos son libres y se van generando por el funcionamiento del mercado y sistemas de economía mixta donde las reglas se dirigen a limitar los excesos de una economía planificada o centralizada y los excesos de una economía libre, dado que ya sea en uno u otro sistema económico se pueden presentar excesos que pueden dañar intereses colectivos.
La economía Centralizada tiende a lesionar los derechos de creatividad de las personas. La economía libre tiende a lesionar a los agentes económicos más desprotegidos en beneficio de los más fuertes.
En el Perú de conformidad con el artículo 58 de la Constitución Política del Estado nuestra economía es una Economía Social de mercado que constituye un sistema económico que defiende la libertad de la iniciativa privada, tratando de buscar crecimiento económico pero también justicia y equidad, considerándose como una tercera vía entere el capitalismo y el socialismo, por lo que este sistema económico en líneas generales no permitiría al gobierno establecer un control de precios.
El día viernes 5 de junio el congreso de la república aprobó la ley que sanciona el acaparamiento, especulación y adulteración de productos y servicios en la zonas declaradas en estado de emergencia, calamidad pública o conmoción con lo cual se modificará el Código Penal y el Código de Protección y Defensa del Consumidor.
En lo que respecta a el delito de acaparamiento se sanciona con 6 años de pena privativa de la libertad a quien genere escasez de bienes o servicios y en lo que respecta a el delito de especulación se sancionará a quien incremente los precios habituales con 8 años de cárcel, siendo el Gobierno quien determinará la lista de bienes esenciales que son materia de protección.
Atendiendo a esta iniciativa legislativa, es indispensable determinar y responder a la pregunta de si ¿Esta norma para homogeneizar un precio justo, establecida como una cura, no constituye más bien un evento que podría ser peor que la enfermedad misma?
El control del estado en la economía desde la óptica de connotados economistas, puede generar severos problemas en la economía Peruana, como:
– Intervención del Estado en los precios ya que los bienes o servicios de similar naturaleza en el
mercado actual, no tienen un mismo precio, ello debido a que se deja a criterio de cada productor
prestador de servicio la forma y calidad de lo que ofrece, lo que ocasionaría la imposibilidad de
propiciar una oferta variada al mercado.
– Intervención del Estado para establecer la lista de productos, este punto es de suma importancia
ya que la lista puede ser ampliada por el Estado como parte de la presión pública, pudiendo el
gobierno determinar dicha lista por conveniencia, en busca de popularidad, así como que podría
ser controlada grupos de poder o de interés particulares
– Intervención del Estado al fijar precios crea mercados negros, esta práctica puede generar
precios elevados dado que los productos que los formales no vendan, para evitar incurrir en
problemas legales, dará cabida a la generación de nuevos mercados informales y con productos de
mayor precio, generando nuevos ofertantes en detrimento del bolsillo de los consumidores.
Es innegable que en la actualidad, dentro de un Estado de emergencia sanitaria por la pandemia por Covid -19, existe un problema económico social, el mismo que clama a gritos soluciones. Nadie, en su sano juicio podría estar de acuerdo con el acaparamiento de productos que generan desabastecimiento de productos esenciales, ni con la especulación de precios de medicamentos que son la única fuente para efectos de resguardar la vida y salud de las personas.
El problema existe y debe ser reparado.
Desde un punto de vista económico, el control de precios lo único que ocasionaría es una desastrosa distorsión en nuestra economía, sin embargo desde el punto de vista legal analizado dentro de contexto de un estado de excepción legal como lo es, el estado de Emergencia Sanitaria, podríamos considerarlo prudente e inclusive justificado socialmente atendiendo a la necesidad de miles de personas por la adquisición de bienes y servicios de salud indispensable para proteger el bien supremo moral y jurídico de la sociedad que es de la Salud y la vida del ser humano.
Sin perjuicio de ello es importante analizar un punto medio, en el cual, tanto el enfoque económico y el enfoque legal converjan en beneficio y cumplimiento del bien supremo que es el Ser humano en sociedad.
Por ello consideramos que, una alternativa adecuada económica y legal, para efectos de cautelar el bienestar de una gran mayoría, frente a los proveedores de estos bienes y servicios de primera necesidad y más aún en un estado de Emergencia Sanitaria es una debida, y reiteramos, una debida intervención del Estado.
Por ello consideramos que se requiere de lo siguiente:
– Una ley que determine un ámbito técnico de implementación y debida supervisión de los precios de
bienes y servicios requeridos para la atención de la emergencia sanitaria,
– La temporalidad de la medida, con la finalidad que esta no se extienda en el tiempo y distorsione
la economía.
– Así como la necesidad de las empresas involucradas de contar con un adecuado Protocolo o
políticas de Buenas Prácticas comerciales en la prestación y comercialización de medicamentos y
servicios de salud.
Estas buenas prácticas o Compliance Empresarial, que constituye el trabajo de las empresas para cumplir en su integridad con las leyes y regulaciones vigentes tanto a nivel nacional como internacional, requieren de la definición de procedimientos y políticas con la finalidad de supervisar el cumplimiento de estas normas y de esta manera ser trasparentes, en este caso, en la formación de precios que finalmente son los de interés social.
Si bien se busca un interés social supremo, en la práctica lo que hacen las empresas vinculadas, al hacer un adecuado protocolo de buenas prácticas comerciales, es cuidar su reputación y la buena imagen de la marca empresarial con la finalidad de evitar fraudes en beneficio de la transparencia de la empresa tanto a un nivel interno como externo, buscando igualmente el respeto de los clientes y el entorno social.
Por ello es importante poner en la mira de las Instituciones de salud la necesidad de un Compliance Empresarial, ello en salvaguarda de su reputación al momento de la formación de sus precios y en beneficio de los usuarios de servicios de salud que finalmente constituyen el bien supremo según nuestra Constitución.
